City Council candidate David Oh will contest the Nov. 6 election in which he finished third in the race for two minority council seats.
Oh said the Board of Elections, City Commissioners and the city of Philadelphia failed to “follow the statutory and legal process governing absentee ballots,” but it was unclear yesterday whether his petition would be accepted.
Oh has asserted that absentee ballots should have been counted at polling places on Election Night rather than brought to the Board of Elections.
Court of Common Pleas Judge Pamela Dembe, acting chair of the Board of Elections, could not be reached for comment last night on Oh’s petition. Yesterday was the deadline both for Oh to contest the election, and the Board to certify the results, which it did.
Oh, a Republican, lost to incumbent Councilman Jack Kelly by 122 votes in the race for two at large seats reserved for the minority party. City Councilman Frank Rizzo was the leading Republican at-large vote-getter.Kelly spokesman Frank Keel said yesterday: “It is deplorable that Mr. Oh is attempting to disenfranchise so many Philadelphia voters with his vague and baseless accusations. This electoral process was open, transparent and above-board. Oh lost — period.”

Why should David "say uncle"? This corrupt process needs to be exposed. In fact, If there was indeed voter fraud that undermined the democratic process, Jack Kelly should be outraged. As a sitting councilman, and bare of city law, it troubles me that his spokesman would find issue with Mr. Oh questioning what he believes to be fraud.
This isn't about David and Jack. It is much larger than any candidate or elected official...Oh should be commended for standing up to these bullies!
The only thing that is deplorable is Mr. Kelly and his operatives disenfranchising the 61,000 folks that voted on election day in favor of David Oh.

Isnt it wonderful that every time someone cant accept losing a close election they resort to calling it fraud?
He lost...that doesn't mean he was cheated. Maybe he just can't accept that more people voted for someone else then voted for him. It happens....its called politics.
And what the heck does Bill Gates have to do with anything?

How many of those votes for someone else were cast legally and properly? If you've got nothing to hide, you shouldn't be afraid of a challenge and investigation.
We're not going to sit around and tolerate corruption and fraud. Period.

I don't know much about Kelly himself but what I do know is that the political party machines in the city can be corrupt and if they see that their establishment candidate is in danger of losing, they will use underhanded ways to halp them win. Usually the party bosses will resort to unscrupulous but nonetheless legal means but they will sort of turn their head as illegal and fraudulent things are done on their behalf to ensure their desired result. That was very likely the case on election day as Mike Meehan the GOP chair was out at the booths trying to keep David Oh's name off of the Republican ballot tickets being handed out. He knows Oh is independent-minded and would try to bring reform.
